Preamble
The “koann.app” website (hereinafter the “Site”) is published by Digitale Stratégie (hereinafter the “Publisher”). The services accessible from the Site are provided by the Publisher, whose contact details are as follows: SAS DIGITALE STRATEGIE, a simplified joint-stock company with share capital of €195,000, SIRET No.: 528 033 079 000 47 – 15 rue Victor Hugo – 97419 La Possession.
These General Terms of Use (hereinafter the “Terms of Use”) are intended to define the conditions governing access to and use of the Site and the Koann service by Internet users, regardless of their status: whether they are simply Visitors (as defined below) to the Site or Users (as defined below) of the Koann Service.
Access to the Site and activation of the Koann account offered through the Site are subject to prior consultation and acceptance of, and full compliance with, these Terms of Use.
Under the conditions described in these Terms of Use, the User may use Koann to identify themselves to a Digital Service (as defined below) offered by the Publisher or one of its Partners (as defined below) displaying the “Koann” login button on its website or application. When the User identifies themselves to a Digital Service using the Koann service, use of said service shall, where applicable, be governed by the specific terms of use applicable to that service and subject to separate acceptance by the User wishing to use it. The specific terms of the Digital Service shall therefore supplement these Terms of Use.
Definitions
In these Terms, words or expressions beginning with a capital letter shall have the following meanings:
- Koann Login Button: Clickable button displayed on a Partner website allowing a User to identify themselves using their Koann account in order to access a Digital Service.
- Confirmation Code: Single-use alphanumeric code sent by the Site via SMS to the mobile telephone number provided by the User during registration in order to validate the User’s mobile number for the Koann Service.
- General Terms of Use (Terms of Use): This agreement between the Publisher and a User concerning the use of the Koann Service and their Koann account.
- Koann Personal Area: Personal area of the Site reserved for the User, containing, in particular, their personal information and allowing them to manage the use of their Koann account.
- Koann Account: Logical link allowing a login and password to be associated with a natural person based on a set of information verified when activated by Koann.
- Partner(s): Persons contractually linked to the Publisher who operate a Digital Service in the form of a website or application and allow the User to identify themselves using their Koann account.
- Digital Service: Service offered by the Publisher and governed, on the one hand, by these Terms of Use and, on the other hand, by the specific terms of use applicable to the relevant service.
- Koann Service: Service allowing a User to activate, modify and delete a Koann account and access Digital Services.
- Site: Koann website owned by the Publisher through which the User accesses the Koann Service, available in particular at koann.app.
- User: Natural person who uses Koann.
- Visitor: Natural person accessing the Site without registering as a User of the Koann Service.
Other definitions:
- Identification: Identification is the process of establishing the identity of the User. It answers the question: “Who are you?”. The User uses an identifier referred to as the Login in these Terms of Use, which identifies them and is individually assigned to them. This identifier is unique.
- Authentication: Authentication is the process by which the User provides proof of their identity. It takes place after the identification stage. It answers the question: “Are you really this person?”. The User uses an authentication credential or “secret code” known only to them.
Presentation of the Koann Service
Koann is intended for any natural person with legal capacity. Koann is designed to allow a User to register under the conditions defined below, so that they may subsequently activate and use their Digital Identity when connecting to Digital Services.
Acceptance of the Terms of Use
Access to and any use of the Site and the Koann Service by a User are subject to compliance with these Terms of Use.
These Terms of Use apply:
- to Visitors: from the moment they connect to the Site until they finish browsing (“log out”);
- to Users: from the activation of their Koann Personal Area and Koann account until their deletion under the conditions set out below, for any reason whatsoever.
Every Visitor and User therefore undertakes to carefully read these Terms of Use before using the Site or the Koann Service and to consult them regularly.
Any Visitor or User who does not agree with all or part of the provisions of the Terms of Use may not browse the Site and/or use Koann.
The Publisher may amend all or part of these Terms of Use at any time. The amended Terms of Use shall become binding on the User after the User has been informed thereof and has accepted them by any appropriate means. The User may not use Koann until they have expressly accepted the new version of the Terms of Use, which will automatically be displayed when they connect to the Site.
Every User or Visitor of the Site and/or Koann Service must refer to the sole online version available on the date of consultation, which shall automatically be the latest version of these Terms of Use. They may download and/or print it. In the event of any conflict with other rules, policies or operating procedures that do not expressly provide for an exception, these Terms of Use shall prevail.
Conditions of Access to the Site
The Site is accessible at koann.app.
To access the Site, Visitors and Users must have the hardware and software necessary to connect to the Site, including, without limitation, a device or terminal compatible with the Site and capable of connecting to the Internet. The Publisher does not guarantee that the Site will be accessible on all devices, including computers, smartphones, tablets or other devices. All costs, fees, subscriptions and taxes relating to Internet access shall remain the sole responsibility of the Internet user.
The Publisher shall use all reasonable means to make the Site accessible 24 hours a day, seven days a week, except in cases of force majeure or events beyond the control of the Publisher (or its service providers), and subject to maintenance periods and possible outages.
Whenever possible, the Publisher shall notify Users and Visitors in advance of interruptions or shutdowns affecting all or part of the Site.
Every Visitor and User acknowledges that they understand the Internet and its limitations, including its functional characteristics and technical performance, risks of interruption, response times for consulting, querying or transferring information, and the risks inherent in any transfer of data, particularly over open networks.
Each User undertakes not to modify, attempt to modify or interfere with the Site or the Koann Service in any way whatsoever and not to use software or any form of computer program intended to access or make available protected content or content that is not freely available. It is also prohibited to create any work or website derived from all or part of the Site or Koann Service.
The User undertakes to inform the Publisher without delay, by any means, of any error, fault or irregularity discovered while using the Site, as soon as they become aware of it.
Activation of the Koann Account
Access to the Koann Service is subject to the creation of a Koann Personal Area and activation of the Koann account under the conditions defined below.
Koann is provided free of charge to Users.
Creation of a Koann Personal Area is exclusively reserved for:
- persons with legal capacity (persons over 18 years of age on the date of registration who are not subject to guardianship, curatorship or judicial protection), who alone are authorised to create a Personal Area; and
- legally incapacitated adults and minors, provided that they have obtained the prior written authorisation of their legal representatives.
Creation of a Koann Personal Area and activation of the Koann account for legally incapacitated adults and minors shall be subject to the provision of authorisation from their legal representatives.
Any Visitor registering on the Site to activate a Koann account and use the Koann Service represents and warrants:
- that they have full legal capacity;
- or that they have received authorisation from their legal representatives if the Visitor is a legally incapacitated adult or a minor;
- and that all information provided during registration is true and accurate.
Creation of the Koann Personal Area
To activate the Koann account, the User is invited to create their Koann Personal Area. To do so, the User must register an email address and create a password under the conditions described below.
Registration of an Email Address
Creation of the Koann Personal Area requires the User to register an email address. This email address will serve as the User’s login identifier. The User must enter a valid email address in the corresponding field and submit it.
An automatic email is then sent to the email address entered by the User, containing a hyperlink allowing the User to confirm that address. The User has 30 days to confirm their email address. After this period, the email address will be deleted from the Site’s database and the hyperlink will be deactivated.
Once the hyperlink has been clicked, the User is redirected to the Personal Area creation request form in order to enter a password.
Password Entry
The User must then create a password associated with the registered email address.
This password must comply with the security requirements established by the Site. It is strictly personal and must not be disclosed by the User to anyone.
The User must then accept these Terms of Use as well as the personal data protection policy.
Once the above steps have been completed, the Koann Personal Area is created and the User may continue the process of activating their Koann account in accordance with the steps described below.
Deletion of the Koann Personal Area at the User’s Request
The User may delete their Koann Personal Area and Koann account at any time, provided that such deletion is duly justified. To do so, the User must submit a request to the Publisher through the contact form available by clicking here. The Personal Area will be closed by the Publisher after contacting the User to confirm their intention to delete their Koann Personal Area and Koann account.
Upon confirmation, the User’s Koann account will be permanently deleted and the User will no longer be able to log in to their Koann Personal Area or access Digital Services via the Koann Login Button.
The User is nevertheless informed that the Publisher may retain personal data relating to the use of their Koann Personal Area and Koann account for the applicable statutory limitation periods in order to comply with its legal and regulatory obligations.
Access to and Management of the Koann Personal Area
To access their Koann Personal Area, the User must enter, on the Site’s home page, the email address and password used when creating their Koann Personal Area. These credentials are strictly personal and confidential. The User undertakes to comply with the security rules stipulated in Article 16 concerning their login credentials.
If the password is lost or forgotten, the User may reset it. Password reset is subject to a secure process requiring the User to have access to the email account and mobile phone associated with their Koann account.
If the User has not completed the Koann account activation process, they may resume the activation process using a link provided from the step that has not yet been validated. By clicking on it, the User is redirected to the outstanding step in order to complete activation of their Digital Identity.
Modification of Personal Information
The User may modify certain personal information provided during registration and forming part of their Koann account through the “Personal Data” tab in their Koann Personal Area.
The User may therefore modify their email address, password and telephone number.
Changes may only be made one at a time; in other words, the User may not modify more than one item of personal data simultaneously.
Other data become read-only once activation of the Digital Identity has been validated and cannot be freely modified.
Use of the Koann Login Button
The User may use their Koann account to identify themselves on Digital Services through the Koann Login Button and purchase products and/or subscribe to services on their own behalf or, where applicable, in the name and on behalf of the legal entity they represent or their principals.
The Koann Login Button allows Users to enter their Koann credentials (email address and password) and access the Partner website without the Partner being able to obtain the User’s login identifier or password.
The verification carried out by the Publisher during the Koann account activation process makes it possible to associate a User with an identified natural person.
When identifying themselves on a Partner website using the Koann button, the User authorises the Publisher to transmit their identity and any other information necessary for the proper operation of the service offered by the relevant Partner.
Where necessary, the Partner website may retrieve information held by the Publisher concerning the extent of the User’s authority (for example, authority to bind a company or mandates).
The conditions applicable to access to, provision and use of information and services, as well as the prices and payment terms relating to Partner applications and websites accessible to the User, are those established by the Partners and provided by them.
The Publisher remains entirely independent of any contractual relationship that may be established between the User and any Partner, including where such contractual relationship is established after the User has chosen to connect using the Koann Login Button.
In this respect, the User shall be solely responsible, without recourse against the Publisher, for any harmful act committed against a Partner, including any failure to perform contractual obligations undertaken towards a Partner.
Termination
The User may terminate these Terms of Use at any time by deleting their Koann Personal Area in accordance with Article 7 or by ceasing to use Koann for two consecutive years, in which case their Koann Personal Area will automatically be deleted in accordance with Article 6.
The Publisher reserves the right to discontinue the Site and/or Koann Service at any time by notifying the User by any means, subject to reasonable notice.
In the event of a breach by the User of the provisions of these Terms of Use, particularly in the event of fraud, the Publisher reserves the right to take immediate action to stop and, where applicable, penalise such breach. The Publisher may therefore suspend the User’s Koann Personal Area, permanently close it or refuse activation of the Koann account, without prejudice to any damages that the Publisher may be entitled to claim.
In the event of a serious and repeated breach by the User of any of their obligations under these Terms of Use, the Publisher reserves the right to send the User a warning email and to temporarily suspend or terminate access to and use of the Koann Personal Area and the Site, without judicial formalities, compensation or prejudice to any damages that the Publisher may be entitled to claim. In such a case, the User will be informed of the reason for the suspension or termination of their Personal Area and, where applicable, the duration of the suspension. The sanctions described above may be imposed without prejudice to any criminal or civil proceedings that may be brought against the User by public authorities, third parties or the Publisher.
Any termination shall result in the invalidation of the User’s Koann account.
Liability
The Publisher provides no express or implied warranty, including, without limitation, warranties relating to the quality and compatibility of the services and information offered through the Site for any specific purpose, or regarding compliance by Visitors and Users with the Site’s Terms of Use. The Site is constantly evolving. Visitors and Users acknowledge and agree that the nature and form of the Site and Koann Service may change from time to time.
Likewise, the Publisher cannot guarantee that no errors or other operational or usage problems will occur during use of the Site and/or Koann Service.
The Publisher may not be held liable for any loss, fraud or damage arising from the User’s failure to comply with their contractual obligations, particularly their obligation to provide accurate, truthful and up-to-date information. The User expressly acknowledges that the Publisher shall not be held liable in the event of false statements concerning their identity.
The Publisher’s liability is limited to the accuracy of the information that it has been able to verify based on the information and documents provided by the User.
The Publisher shall not be held liable for any damage caused to the public and/or a User as a result of any modification to such information of which the Publisher was unaware.
The Publisher shall not be liable for the unavailability of networks (software or hardware) that are not entirely under its direct control, nor for any modification, suspension or interruption in the availability of the Site or Koann Service, nor for their continuity, sustainability, compliance, compatibility, performance or absence of bugs.
The Publisher shall not be liable for fraudulent use of the User’s confidential login credentials by a third party.
The User uses Koann under their sole responsibility. The User acknowledges that they may incur liability, particularly in the event of identity theft, in accordance with Article 226-4-1 of the French Criminal Code, which provides for a penalty of one year’s imprisonment and a fine of €15,000 for identity theft. The User undertakes to use Koann in accordance with these Terms of Use and applicable regulations.
The User is responsible for the use of their Koann Personal Area and their login credentials.
The User is solely responsible for the consequences of failing to update their information. Where the information provided is inaccurate, incomplete or outdated, the User shall be solely responsible for any failure in the Koann Service identity verification process.
The User is responsible for all damage caused by them to the Publisher.
The User undertakes to indemnify the Publisher in the event of any request, claim or award of damages made against the Publisher as a result of failure to comply with these provisions or damage caused to others or to the User themselves by documents distributed by the User through the Site and/or Koann.
The User shall indemnify and hold the Publisher harmless against any claim, allegation or demand by third parties alleging infringement of their rights as a result of the User’s use of the Site and/or Koann Service or measures taken by the Publisher to put an end to the alleged infringement of third-party rights.
The Visitor, User and Publisher expressly agree that this Article shall survive any total or partial termination of these Terms of Use, regardless of the reason for such termination.
Force Majeure
Under no circumstances may the Publisher be held liable, nor may any compensation be claimed from it, for delays or harmful consequences resulting from a force majeure event as defined by Article 1218 of the French Civil Code. The occurrence of a force majeure event shall suspend performance of the Site and/or Koann Service.
The Publisher shall, where reasonably possible, endeavour to inform Users of the existence of such force majeure event, restore access to the Koann Service, even in degraded mode, or implement any other technical solution enabling Users to regain access to the Koann Service.
If the impediment is permanent, the agreement between the Publisher and the User shall automatically terminate and the parties shall be released from their obligations under the conditions provided for in Articles 1351 and 1351-1 of the French Civil Code.
Cookies
The Publisher may use tracking technologies, commonly known as cookies, on its Site.
For more information about the cookie management policy, Visitors and Users are invited to read it by clicking here.

Telephone Solicitation Opt-Out List
The Publisher undertakes to use the telephone contact details of consumer Users only for the proper performance of the Koann Service and management of the Koann Personal Area. Without prejudice to the foregoing, in accordance with Article L. 223-2 of the French Consumer Code, the User is informed that they have the right, if they so wish, to register on the Bloctel telephone solicitation opt-out list managed by Opposetel and available at www.bloctel.gouv.fr. Registration on this list is free of charge.

The Site and Koann are the exclusive property of the Publisher. In general, the Publisher grants a free, personal, non-exclusive and non-transferable right to access and use the Site and Koann Service. All other rights are expressly excluded without the Publisher’s prior written consent.
All content available on the Site and/or Koann Service, including texts, software, scripts, graphics, photographs, sounds, music, videos and interactive features, is owned by or licensed to the Publisher, including by third-party companies. Such content is protected by copyright, trademark law and all other intellectual property rights or related rights held by the Publisher or its licensors. All third-party trademarks appearing on the Site are trademark rights held by their respective owners.
Subject to the Visitor’s and/or User’s acceptance of and compliance with these Terms of Use, the Publisher grants them, for the duration of their use of the Site and/or Koann Service, a free, non-exclusive, personal, non-transferable, non-assignable and non-sublicensable licence to access and use the Site for the duration of these Terms of Use, solely for the purpose of accessing and using the information and services available on the Site under the conditions set out herein. Under the right of use granted by the Publisher, the Visitor and/or User may permanently or temporarily reproduce the Site for the purposes of loading, displaying, reading, executing or transmitting content available on the Site on the Visitor’s and/or User’s terminal and/or reading device.

Visitors and Users shall refrain from any use of the Site and/or Koann Service outside the scope defined by this licence without the Publisher’s prior written consent.
Visitors and Users undertake to respect the intellectual property rights of the Publisher and/or its Partners, whether existing or future, including intellectual property rights relating to all protected elements involved in the operation of the Site and Koann Service, including, without limitation, trademarks, logos, icons, software and databases. Any use, reproduction or representation, in whole or in part, of protected elements without the prior written authorisation of the Publisher, its Partners or third parties is prohibited and constitutes civil and criminal infringement. The Publisher also reserves the right to delete the User’s Koann Personal Area in the event of infringement.
It is expressly agreed that Visitors and Users shall not correct any anomaly themselves, regardless of its nature.
The Visitor, User and Publisher expressly agree that this Article shall survive any total or partial termination of these Terms of Use, regardless of the reason for such termination.
Hyperlinks from the Site
Hyperlinks to Third-Party Websites
The Site may contain hyperlinks to other websites that are not owned or controlled by the Publisher, including those relating to companies, Partner websites or Commercial Court registries (hereinafter “Third-Party Websites”). Internet users are informed that by clicking on such links they leave the Site and are redirected to third-party websites and/or applications.
Users and Visitors may not reproduce hyperlinks appearing on the Site.
The Publisher exercises no control over the content, personal data protection policies or practices of Third-Party Websites and accepts no liability in this respect.
The Publisher is not responsible for the availability of Third-Party Websites or external resources and does not endorse any advertising, products or other materials available on such Third-Party Websites. Consequently, the operators of such Third-Party Websites are solely responsible for compliance with applicable laws and regulations. The Publisher accepts no liability for any damage resulting from the use of such Third-Party Websites.
Hyperlinks to the Site
Any hyperlink to the Site using, in particular, the following techniques is prohibited without the Publisher’s prior authorisation:
“Framing”, defined as a technique that allows a page from the Site to be displayed within a frame on the original website without leaving that website;
“Inline linking”, defined as a hyperlink that allows an image from another web page to be included within the original web page.
IT Security
Visitors and Users undertake not to engage in any activity on the Site that may disrupt or attempt to disrupt the operation of the Site or Koann.
Any access to the Site using the User’s login credentials shall be the sole responsibility of that User.
To ensure the security of their Personal Area, the User undertakes to:
- not disclose their password to third parties (the stored password is encrypted);
- take all necessary precautions to prevent third parties from gaining access to it;
- take all measures necessary to prevent a third party from accessing the Koann Personal Area activated by the User, even without the User’s knowledge;
- not grant a third party access to their Koann Personal Area.
The User is informed that if they choose to be automatically logged in on their computer, any third party using that computer may potentially use the service through their Koann Personal Area. Consequently, to limit this risk, the User is advised to secure access to their Koann Personal Area (deleting cookies and automatic login information, closing active sessions, etc.).
The User acknowledges and agrees that all actions associated with their Koann Personal Area shall be deemed to have been carried out by them.
The User is therefore responsible for the consequences of actions carried out through their Personal Area, including any damage or loss caused in breach of applicable law, third-party rights or these Terms of Use.
If the User reasonably suspects a security breach, including the loss, theft or unauthorised use of their email address and password or any other security issue affecting their Koann Personal Area, they must immediately notify the Publisher through the contact form available here, so that the Publisher may take appropriate measures to remedy the situation. The Publisher may then reset the User’s password and, where appropriate, block access to the Koann Personal Area concerned.
Assignment
The Publisher may freely assign all or part of its rights and obligations under these Terms of Use at any time (including through the sale of a business, contribution of assets or merger). Where such assignment is likely to result in a reduction of the User’s rights under these Terms of Use and in connection with use of the Site and/or Koann Service, the Publisher shall inform the User in advance. If the User refuses the terms of the assignment, they may immediately close their Koann Personal Area. However, deletion of the Koann Personal Area by the User as a result of such assignment shall not entitle the User to any compensation from the Publisher or its assignee.
Subcontracting
The Publisher reserves the right to subcontract all or part of the services covered by these Terms of Use to any company of its choice. The Publisher shall remain solely responsible towards the User, and the subcontractor shall be required to include a hyperlink to its privacy policy.
Notification
For any question, information request or notification, Visitors and/or Users may contact the Publisher through the contact form available here.
General Provisions
In the event of any difficulty in interpreting any heading appearing above a clause in relation to that clause, or between several headings, the headings shall be deemed not to exist.
If one or more provisions of these Terms of Use are found to be ineffective, this shall not affect the validity of the remaining provisions. The same shall apply if these Terms of Use contain any omissions. Any provision that must be removed or is missing shall be replaced by a legally valid provision consistent with the purpose of these Terms of Use.
Failure by the Publisher to require or enforce the performance by a Visitor or User of any provision of these Terms of Use shall not be interpreted as a waiver by the Publisher of its right to require or enforce such provision.
Except as expressly and specifically provided in these Terms of Use, statements, agreements, waivers or other acts or omissions by the Publisher shall under no circumstances be interpreted as intended to amend these Terms of Use and shall only be binding if made in writing and signed by the Visitor or User and the Publisher’s legal representative.
Complaints – Jurisdiction and Applicable Law
These Terms of Use shall be governed, interpreted and enforced in accordance with French law. In the event of a dispute concerning the meaning of any term or provision herein, French shall be the language of interpretation.
In the event of any difficulty relating to the use of the Site and/or Koann Service or the validity, interpretation or performance of these Terms of Use, the Internet user may contact the Publisher using the contact form available on the Site (here).
The Publisher shall acknowledge receipt of the complaint within a maximum period of ten (10) business days from receipt.
A response to the complaint shall be provided within a maximum period of thirty (30) business days from receipt, except in the event of duly justified special circumstances.
If the Publisher is unable to provide a response within this period, the Publisher shall contact the person concerned to explain the reason for the delay and indicate the timeframe within which a response can be provided.
SUBJECT TO APPLICABLE PROVISIONS REGARDING JURISDICTION OR CONSUMER PROTECTION, THE CIVIL COURTS WITHIN THE JURISDICTION OF THE PARIS COURT OF APPEAL SHALL HAVE EXCLUSIVE JURISDICTION OVER ANY DISPUTE RELATING TO THESE TERMS.
The Visitor, User and Publisher expressly agree that this Article shall survive any total or partial termination of these Terms of Use, regardless of the reason for such termination.
Telephone Contact and Solicitation
In accordance with French Law No. 2025-594 of 30 June 2025 relating to telephone solicitation, Koann may contact you by telephone (including through an automated voice assistant) for the purposes of connecting you with relevant parties or providing information about its services, subject to your prior and express consent, obtained separately during registration and which may be changed at any time. Refusal to provide consent shall have no effect on your access to the Site or the Koann Service.
Koanns and Participation in Our Research
Experience points (XP) have been replaced by a virtual currency called Koanns (ҡ). Koanns reward you for completing your profile and taking the available tests and questionnaires.
Controlled Experiments
In order to improve our platform and provide you with the best possible experience, we conduct controlled experiments (A/B tests) in which different users may see different versions of features or content. Some of this research is conducted in collaboration with academic partners, and the results may be published in a form that does not allow you to be identified.
If you agree, your activity on the platform may be included in these tests and analysed in anonymised form for these purposes.
Your Choice
Participation is voluntary. Refusing to participate will not affect your access to the service or your Koanns: the Koanns system applies to all users, regardless of this choice.
You may withdraw or ask questions at any time by contacting support@koann.io.
